EMMA Membership Terms & ConDITions
Membership of the Experiential Marketing Measurement Coalition, doing business as the Event Marketing Measurement Association (EMMA) is subject to the following Terms and Conditions. These Terms and Conditions outline the relationship between the Event Marketing Measurement Association (“EMMA”, “we”, or “us”) and each individual member (“you”). Please read them carefully.
These Terms and Conditions are subject to change at any time, effective upon posting to the EMMA’s website at www.eventmeasurement.org. Your membership in the EMMA will constitute acceptance by you of such changes. You are responsible for regularly checking these Terms and Conditions, determining if there have been any changes and reviewing such changes.
1. Membership
EMMA charges an annual fee (“Annual Dues”) for membership of $199 (or the equivalent in your local currency). You will be billed annually and a direct-debit option will be provided if preferred. Membership fees are due within 30 days of membership application approval. Current member must renew your membership on or before the completion of the twelfth month of membership each year (you will be sent reminders). Your membership in EMMA will terminate if you fail to pay your Annual Dues in any year.
2. Member Benefits
On payment of your Annual Dues, as a member of EMMA you will be entitled to receive the following benefits:
· Use of the EMMA logo and brand name on promotional materials (e.g. website, social channels, etc.)
· Invitation to ‘free to member’ EMMA meetings and events
· Discounted access to EMMA meetings and events that feature an admission free
· Access to the member section of the EMMA website
· First look access to EMMA content, including measurement tools, whitepapers, studies, and more
· Participation in the EMMA measurement certification program at a reduced enrollment cost
· Participation in EMMA member exclusive Slack group discussions
· Engagement with top strategists in the Events and Experiential Marketing industries
· Opportunities to express thought leadership by writing and/or speaking for the EMMA
· Vote in the annual election of the EMMA’s Board of Directors
· Eligibility to serve on the EMMA Board of Directors
· Eligibility to contribute to EMMA action groups by serving on one or more of its Operating Committees
Member benefits may be added or removed at any time, at the sole discretion of EMMA. You will be made aware of these changes as and when they occur.
3. Your commitment as an EMMA Member
As an EMMA Member, you agree:
· Not to share confidential information from your business and/or employer;
· Not to use the EMMA as a sales platform for your business or services provided by your business;
· To behave in a professional manner in all EMMA interactions.
4. Compliance with Bylaws
By joining the EMMA, you agree to comply with Experiential Marketing Measurement Coalition (doing business as EMMA) bylaws, which are available to download from the members area of the website at www.eventmeasurement.org and/or will be sent to you as part of your member orientation package. Failure to comply with these Bylaws may result in your membership of EMMA being terminated by us at our discretion.
5. Ownership of Materials
As a member of EMMA, you agree not to assert any right, title, or interest in any materials prepared by or on behalf of EMMA (“EMMA Materials”). You are entitled to use these materials solely for your own professional and/or business purposes, and not to distribute, loan, or resell them to any third party. As a member you agree to keep all EMMA internal communications and all EMMA Materials confidential for the duration of your membership and for five (5) years following the termination of your membership of the EMMA, for whatever reason.
6. Disclaimer
Both you and EMMA agree that neither one of us will claim any representation or warranty, whether express, implied, statutory or otherwise, in connection with your membership of the EMMA or with any of the EMMA Materials. This includes any warranties of title, non-infringement, merchantability, or fitness for a particular purpose. You accept that EMMA makes no representation or warranty that any of EMMA materials is valid, and further, that the exercise of your rights as a member will not infringe the rights of any other person, regardless of their EMMA membership status.
7. Limitation of Liability
Neither you nor EMMA will be liable to each other or to any third party for any consequential, incidental, indirect, exemplary, special, or punitive damages relating to your membership of EMMA or your use of EMMA materials, regardless of whether such damage was foreseeable or whether either of us has been advised of the possibility of such damages.
8. Cancellation and Transfer of Membership
You may cancel your membership with us at any time, but no refund, either partial or in full, of Member Dues paid will be given unless we have materially breached any of these Terms & Conditions. Membership of EMMA is not transferable and you may not assign the benefits of membership to any third party.
9. Miscellaneous
In the event that any portion of these Terms & Conditions is held to be invalid or unenforceable, the invalid or unenforceable portion shall be construed in accordance with the applicable law as nearly as possible to reflect your original intentions as a member and those of EMMA, and the remainder of our Agreement shall remain in full force and effect. The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Terms & Conditions. Any failure on our part to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
These Terms & Conditions shall be governed by and construed in accordance with the laws of the U.S. State of South Carolina, in the case of members whose main place of business is the United States of America, and with the laws of England and Wales in the case of all members whose main place of business is outside of the U.S.A.
